The NJDEP’s newly released “Technical Guidance for Investigating Child Care Centers & Educational Facilities” (Version 1.0, Feb. 2017) provides guidance for the remediation of properties where licensed child care centers (CECs) or educational facilities (EFs) are involved.  

The Madden Legislation requires that licenses be issued for new or expanding CCC/EFs prior to the issuance of construction permits or certificates of occupancy for such facilities.  The licenses, which are issued by the New Jersey Department of Children and Families (NJDCF), require that the applicant conduct a Preliminary Assessment (PA) for the subject property or leasehold and obtain a Response Action Outcome (RAO) from a Licensed Site Remediation Professional (LSRP).  A Safe Building Interior Certification (SBIC) is also required from the New Jersey Department of Health (NJDOH).
